Judgement of Mr Justice Garrett Simons in the case taken by Coastal Concern Alliance against the Minister for Housing, Local Government and Heritage challenging grant of Foreshore Licence to RWE in 2021.

Judgement of the High Court.

In a Judicial Review case heard in July 2024, the Minister for Housing, Local Government and Heritage on behalf of the State, conceded that the Foreshore Licence granted to RWE, a multinational energy company seeking to build a wind farm on the Kish-Bray Banks, was granted in breach of the Habitats Directive.  Judge Simons was highly critical of the Marine Licence Vetting Committee and the Minister’s office for failing to correctly assess the application made by RWE before granting the licence.
